Just had to buy another XBOX 360 after 1st one got banned from Live.
Is it worth having the new one flashed and only using orginal games on live or can they still tell so son can still play all his backuos offline.
Any views helpfull.
Nope, Its 99% safe. I think they actually encourage that sort of thing.

You're safe. They won't know if you're playing backups offline.

Just to back things up MS apparently cant detect the firmware and the console has to be online and the disc spinning in the drive for them to detect its not original so disconecting from live by removing the ethernet cable should be ok

Sorry but I don't buy that.
Lets be honest nobody outside MS know 100% for certain why the last lot of bans occured. We speculated a lot. First Kreon Rips were blamed. Then Kreon were exhonorated. 1 School of thought sugests playing before release date was to blame... other played before and got no ban.
Stealth firmwares were all but useless as on the last wave bans were indiscriminare. Every drive and every firmware saw banned users.
It's logical to say if firmwares aren't detected then somehow its the rips. If the rips can be detected online then it can be implemented to scan offline.
If you remember after the last fall dash update new firmwares came out. All of a sudden there was a minor patch users were forced to accept... coincidence? MS claimed it was to allow the Scene it controllers to work. Surely if this was the case (doubtful as it was quite some time before the game was actually released) surely the update would have been on the game disc in question and not rammed down the throat of every user... especially those that never intended to buy the game.
I know dozens of users that heeded the warnings and never went online after the 2nd wave of bans. Stayed off for weeks on end. As soon as they fired up the console... even with originals they were banned and could not log on. Even if they were just on dash and never had a DVD/Game in the drive.
MS can detect certain bacups on a system I suspect both Offline and online.
It's 100% speculation but i wouldn't be at all surprised if MS released a rip under the guise of a group specifically to trap the odd users. This would explain why some people are still playing certain backups online even now and have done so all along.
my nephew was a prime candidate for a ban. He played games on original early firmware (hitachi) and he even played non stealth rips without the correct PFI/DMI's. I always assumed he was banned because his account expired and he never renewed. A few days ago he popped up online (on my friends list) not only playing some of the latest rips but also some of the old non stealth ones as well.
It just doesn't tally.
Sufficed to say nobody knows. If you are that concerned about a ban the only way to avoid is to not flash firmware and to not play DVD+R D/L. It's as simple as that I'm afraid.
I personally know probably 20 banned consoles and I know many more still playing rips on an assortment of f/w drive combinations. At least a few of which probably have over 100 games in their achievement list all of which are scene releases.

Thats what i got m8, my banned one for backups and a normal unflashed 360 for Live to use with originals, just swap my HDD between the two to register the achievement points and save games etc

I was banned on the first wave, a long time ago, Second wave i was safe...
I couldnt imagine going back to purchasing all of these games once again. I have had to swap xbox's and reflash ( once banned, other time 3 rrod), all in all each time i swap it costs me from 50-100 usd, but i think its worth it.
Im pretty sure with the next console we will not be able to play online with a modded unit, might aswell take advantage of it while its available

Just go online with the one you have. If you get banned then go out and buy a core foer £150ish. At the end of the day thats only a little over the cost of 3 reail games if you coughed up for em.
How many games (COD4 notwithstanding) are actually worth £45 anyhow?

There's really no need for speculation about the fw. M$ can't detect the firmware unless it returned a name like 'iXtreme 1.4' but that could be changed if that was the case just like it can be change don your PC.
Honestly if you're 1 of those paranoid people who is going to stay up nights thinking you'll be banned, then there's no point in even having a discussion in the 360 backup forum.
For those who understand how games and firmwares are released, you knows it's not reasonable for M$ to release anything "under the guise of a group" without people being highly suspicious. If you get your games/firmwares through the proper channels, you really have nothing to worry about in that regard. If for example someone released a game under the name VORTEX, it would be 5m before an actual VORTEX group member had it nuked as being fake and not pred by them. M$ would need to release a long list of working games/firmwares "under the guise of a group" before they gained enough trust to be able to screw us all with a game/fw that would let them know we were playing backups.

Very valid points, but Im sure Pro Evo 8 was released by an unkown (to me) group.

Indeed .. and both releases were nuked. ;) You could still download them but as they were nuked (and the reasons why even more importantly) you're aware that you're taking chances. That's all I was trying to say. :)

Some groups steal P2P/newsgroup releases and re-badge them.
Also there are a number of release groups that have sprung from nowhere.
As far as trusting Scene releases... well I'm fairly confident there have been some very suspect rips.
Not saying that said groups don't have pedigree... but some are unknown quantities.
Anyhow, like you I doubt MS would employ such a tactic, but I'd certainly bank on the fact what you've played is somehow logged on your 360, maybe even without hard drive and without an internet connection.
When there were online logs of drive interrogations the f/w boys presumed there was no protection/detection that they could see during log on. Many people still got banned and as I say WERE banned when they went back online after the initial waves were over.
If you get marked up, your card is marked. If not cross your fingers and get on with it :-)

just keep your banned one for offline play for all them rubbish, average games that ain't much cop online and swap Harddrives between the two of them to upload achievements, then buy any orginals you want for your legit console. I've just done this because had my previously 4 consoles banned!, all with latest f/w at the time. Yes 4 as i had one and my kids had one that got banned in 1st wave then again in 2nd wave. So just got a arcade edition comming tomorrow along with Gears of War, PGR4, Halo 3 as these are the only online games having (got COD4 and Burnout Paradise on the PS3) and pre-ordered R6V 2 just purely for online play only.
Makes sense TBH
