xbox live and flashed drive

guys
if i own a flashed xbox360 and i go online with an orginal game will i be banned or do u get banned only when you play with a backup online ?
sorry if this has been asked before but i have tried to search but can't find the answer.

well with the xbox 1 you do if u have the chip on and still use an original u get banned ?

im thinking the same but i dont think they will unless they can read the firmware of the dvd drive itself ?????
